Who We Are & How Our Business Works
Dipped makes small-batch, chocolate-dipped treats (like caramel apples, strawberries, and other seasonal desserts). We sell in our California storefronts and limited items online for shipment within the U.S. (where permitted).

Eligibility & Your Account
Keep your account info accurate and secure. We may refuse, limit, or cancel orders for any lawful reason (e.g., suspected fraud or safety concerns).

Orders, Payment & Taxes
Prices and availability can change at any time. Applicable sales tax is added as required by law.
We accept the payment methods shown at checkout and charge your method when your order is processed. If we cannot fulfill an order after payment, we’ll cancel and issue a refund to the original method.

Service Declined
We reserve the right to refuse service to anyone, for any reason or for no reason at any time.

Product Variations, Ingredients & Substitutions
We craft by hand and source seasonally and exact appearance can vary. If an ingredient becomes unavailable, we may substitute a comparable ingredient/topping of equal or greater quality.

Allergy, Ingredient & Food Safety Notice
Our kitchen handles peanuts, tree nuts, dairy, soy, wheat/gluten, and other common allergens. While we use care, cross-contact may occur. If you have a severe allergy or medical dietary restriction, consult your physician before consuming our products. You are responsible for reading ingredient info and deciding whether our products are appropriate for you.

Intellectual Property (Copyrights & Trademarks)
All site content (text, photos, videos, graphics, code) and our names, logos, and product designs are owned by or licensed to Dipped, LLC and protected by law. You may print or download limited materials solely to place an order with us. Any other use (copying, distribution, derivative works, or commercial use) requires our written permission.

Reviews, Photos & Other User Content
If you post or submit content (reviews, photos, messages), you grant Dipped a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with our business and marketing. Keep things respectful and lawful, we may remove or refuse content we consider abusive, infringing, misleading, or unsafe.

Pricing, Errors & Omissions
We work hard to be accurate, but mistakes happen. We decline any responsibility for the error and cannot be held accountable. We reserve the right to correct the statement or inconvenience at our convenience. We may correct any error (price, availability, description, or image) and cancel affected orders even after submission. If we cancel after you’ve been charged, we’ll refund the charged amount.

Coupons, Promotions, & Credit
Limit one discount or promotion per order. Promotional codes, store credits, or special offers can’t be combined or stacked.

Gift Cards
Unless otherwise stated or where an exception applies, CA gift cards for a set dollar amount generally do not expire and cannot have service fees. Lost or stolen gift cards are like cash and may not be replaced. Promotional or complimentary vouchers may carry restrictions disclosed at issue.

Third-Party Services & Links
We use third-party providers (e.g., payment processors, shipping carriers, local food pick up and delivery services) and may link to non-Dipped websites. We don’t control those sites/services and aren’t responsible for their content, policies, or actions. Your use of them is at your own risk.

Dispute Resolution & Governing Law (U.S. Consumers)
We care about our customers and aim to resolve any issue quickly and fairly. If you have a concern about your order or our services, please contact us first by email so we can work toward a solution.

If we’re unable to resolve a concern informally, any dispute or claim related to these Terms, your purchase, or use of our website will be resolved individually through binding arbitration administered by the American Arbitration Association (AAA), in accordance with its Consumer Arbitration Rules.

For customers located in California, arbitration will take place in Sacramento County, California. For customers located outside of California, arbitration may take place remotely (via video conference) or in the consumer’s home state, as required by applicable law.

To the fullest extent allowed by law, disputes will be handled on an individual basis, not as part of a class action or group claim.

You may opt out of arbitration within 30 days of your first purchase by emailing us with your name, order number, and a statement that you wish to opt out. Opting out does not affect any other portion of these Terms.

These Terms and all claims or disputes between you and Dipped, LLC are governed by the laws of the State of California, excluding its conflict of law rules. However, nothing in this section limits any consumer protection rights you may have under your state’s laws.

For any court actions permitted under this section, the state or federal courts located in Sacramento County, California will have exclusive jurisdiction.

Changes to These Terms
We reserve the right to modify these Terms of Service at any time with or without notice.
